The ban has not been lifted.

New York State is allowing counties to make their own decisions when it comes to whether small scale fireworks are legal to be sold or not.

Most counties have decided to allow the sale of things like sparklers in two specific windows around the Fourth of July and New Years. Albany County, is not one of them. And by one of them, I mean the only one, reports the Times Union.

What's the holdup? Firefighter lobbyists. They're worried about where the stores would stash the goods when the sale windows aren't open. Because you know, fireworks = dangerous.

Actually that equation doesn't really hold up. The fact that we're able to sell sparklers at all was sparked by a firefighter who says the fears are overblown.
